1. Legal basis

1.1.The EU General Data Protection Regulation (GDPR), the Austrian Data Protection Act 2018 (DSG), the Austrian Telecommunications Act 2024 (TKG 2024) and further relevant laws and regulations serve the right to protection of personal data. We process your data exclusively on the basis of the applicable statutory provisions (GDPR, DSG, TKG 2024).

2. General information

2.1.The responsible persons are Mattias Rauter and Christof Stromberger, Waagner-Biro-Straße 124, 8020 Graz. Within the meaning of the GDPR, we are the controller for the processing of your personal data. It is a particular concern of ours to protect and securely store all personal data you entrust to us. In this document you will find out more about how we use and process your personal data.

3. Purpose limitation, legal basis, retention period and data recipients

3.1.We need the personal data collected in order to perform the contract, to fulfil legal obligations, for customer service purposes and for advertising purposes. The data is collected, stored, processed and used for these purposes.

3.2.The legal bases for processing your personal data are, on the one hand, performance of a contract, legitimate interests and the fulfilment of our legal or contractual obligations and, on the other hand, your consent. Failure to provide the data may have various consequences, such as making it impossible to perform contracts.

3.3.We process your personal data, to the extent required, for the duration of the entire business relationship (from initiation and performance through to termination of a contract) and beyond that in accordance with the statutory retention and documentation obligations arising, among others, from the Austrian Business Enterprise Code (UGB) and the Federal Fiscal Code (BAO), as well as until the conclusion of any legal dispute, for the duration of ongoing warranty and guarantee periods, and so on.

4. Contact form

4.1.Your details, including personal data, submitted through our contact form are transmitted to us via a mail server in order to process your enquiry, are further processed and are stored by us. This data is not passed on without your express consent unless there is a legal obligation to do so. Without this data we cannot process your enquiries.

4.2.The data processing takes place on the basis of the statutory provisions of the TKG 2024 and Art. 6 para. 1 lit. a (consent) GDPR.

5. Cookies, other tracking tools and web analytics

5.1.Cookies, other tracking technologies and functions of web analytics services such as Google Analytics (in its current version), Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, may be used on our internet platform in a variety of ways. Cookies are small pieces of text information that allow a user to be recognised and your use of our website to be analysed. The information generated in this way is transferred to the provider's server and stored there. It serves to make our internet presence more user-friendly, more effective and more secure overall. Cookies also serve to measure the frequency of page views and for general navigation.

5.2.By using our website you consent to our setting cookies. You can refuse the acceptance of cookies in your browser settings. For details on how this works, please refer to the instructions provided by your browser manufacturer. If you decide against certain technical and/or functional cookies, the functionality of our website may be limited. Some cookies remain stored on your device until you delete them.

5.3.We have concluded a corresponding data processing agreement with the provider Google Analytics and with other service providers. They have undertaken towards us to comply with the applicable data protection provisions. Further information about the processors we engage can be requested at office@denovo.at.

5.4.Your IP address is recorded and immediately pseudonymised (e.g. by deleting the last 8 bits). Complete anonymisation does not take place, but only a rough localisation remains possible.

5.6.The data processing takes place on the basis of the statutory provisions of the TKG 2024 and Art. 6 GDPR (in particular consent).

6. Consent and right of withdrawal

6.1.Where your consent is required for the processing of your data, we only process it after your express consent.

6.2.As a matter of principle we do not process data of minors, nor are we authorised to do so. By giving your consent you confirm that you have reached the age of 14 or that the consent of your legal guardian has been obtained.

6.3.You can withdraw your consent at any time at the following email address: office@denovo.at. In such a case, the data stored about you to date will be anonymised and subsequently used only for statistical purposes without any personal reference. Withdrawing consent does not affect the lawfulness of the processing carried out on the basis of that consent up to the point of withdrawal.

7. Data security

7.1.Christof Stromberger and Mattias Rauter employ technical and organisational security measures to protect the personal data stored against accidental or deliberate manipulation, loss or destruction and against access by unauthorised persons. Our security measures are continuously improved in line with technological developments.

8. Your rights

8.1.You have the right at any time to obtain information from the controllers Christof Stromberger and Mattias Rauter, Waagner-Biro-Straße 124, 8020 Graz, about the personal data concerning you. Unless a statutory retention obligation applies, you have the right to erasure of this data and to object to the processing. You further have the right to rectification of the data, to restriction of processing, to data portability and to lodge a complaint with the Austrian Data Protection Authority (Wickenburggasse 8-10, 1080 Vienna, email: dsb@dsb.gv.at).
